Product Terms and Conditions

1. Warranty

The Products sold carry a manufacturer's warranty which covers replacement of defective parts found to be defective within the time periods specified for each product component as provided below. The manufacturer's warranty, per component, may be adjusted from time to time, provided, however, the Purchaser's warranty shall be for those time periods specified in this section as of the date of purchase. The warranty specifically excludes damage to the product or any component arising out of misuse, improper installation, abuse or misapplication. OPWC shall replace by UPS, any product which within the above product component warranty period is found to be defective in design, workmanship or material, excluding, however, normal wear and tear and deterioration, provided said product is properly installed and is used by the Purchaser in accordance with generally approved practices or in accordance with the operating instructions. The Purchaser must notify OPWC in writing as soon as any such defect becomes apparent. The defective product must be returned to OPWC not later than 30 days from the date the component was found to be defective. The Purchaser is responsible for the shipping cost to return a defective product or component.

OPWC AND PURCHASER AGREE THAT IN CONSIDERATION OF THE ABOVE EXPRESS WARRANTY, ALL OTHER WARRANTIES OTHER THAN TITLE, EITHER EXPRESSED OR IMPLIED, WHETHER ARISING UNDER LAW OR EQUITY, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXCLUDED FROM THIS CONTRACT.

The sole liability of OPWC and the exclusive remedy of the Purchaser arising out of the manufacture, sale or furnishing of the products hereunder or its use, on warranties or otherwise, shall be limited to the cost of replacement of defective products as herein specified. Further OPWC's maximum liability hereunder, arising from any cause whatsoever, including but not limited to breach of contract or tort (including negligence), shall not exceed the contract price of the products furnished hereunder.

2. Shipping Policy

We ship our products anywhere in the domestic, continental United States (lower 48 states). All orders are shipped the next business day after ordering. The price of all products includes applicable UPS Ground shipping (unless otherwise specified or informed). UPS 2nd Day and UPS Overnight shipping are available for an additional cost. You can determine the UPS 2nd Day and UPS Overnight shipping costs by placing the item in the cart and starting the checkout procedure. You will have to enter you name and address information but no credit card information to see the applicable additional prices. UPS 2nd Day and UPS Overnight shipping charges on our website apply ONLY to orders being shipped within the continental United States. In addition, any orders placed late in the week requesting UPS 2nd Day or UPS Overnight may not be delivered until the following Monday UNLESS your address has Saturday deliveries available with UPS. We cannot control the availability of UPS Saturday deliveries in your area.

We also ship outside of the continental United States. See International Orders below.

ALWAYS INSPECT YOUR SHIPMENT WITHIN 24 HOURS OF RECEIPT!! If products are damaged in shipping, PURCHASER must contact UPS within 24 hours of receipt to submit a claim for the damage. Also, contact us to let us know you have submitted a claim with UPS.

Since all orders are shipped via UPS, (unless otherwise specified or informed), we will always have a tracking number providing shipping information about your order. We will send you the tracking number to your e-mail address provided when you order. If no e-mail address is provided, you can call us for the tracking number information.

Once UPS has delivered the products to your location, (this is determined by seeing that the tracking information has a delivered status), the OPWC cannot be held liable or responsible for lost, stolen, or damaged goods. As stated above, Purchaser must contact UPS in you local city or town and report the problem. Once you have done so, let us know the claim number they have given you.

Products ordered that are not deliverable due to incorrect addresses provided or if the person placing the order has moved or is moving and has not contacted us with the update or if the freight company is unable to make contact with the recipient in order to deliver ordered products, will be charged for all shipping charges and restocking fees (if applicable) incurred by us. These charges include the shipping to the provided address and the return charges to our warehouse and any applicable restocking fees. The maximum credit that will be processed in this scenario is the original price charged minus the to and from shipping charges incurred, minus any applicable restocking fees.

3. 120 Day Money Back Guarantee & Return Policy

All of our products (excluding Delonghi Portable Air Conditioners, Avanti and VitaPur Water Dispensers, GE Merlin RO Systems, and Greenway Portable Ice Makers) have a full 120 day, 100% satisfaction guarantee. Simply send the item(s) back for a full refund of the purchase price less UPS 2nd Day or UPS Overnight shipping charges, if applicable to your order. If UPS Ground is selected, then you will receive a 100% refund since this shipping cost is included in the price.

You are also responsible for the shipping cost to return the item(s) to us. For your protection, you may want to insure the return shipment as we will not be held responsible for the condition of the products being returned or for lost or misdirected items shipped back to us.

5. Consequential Damages

Notwithstanding any other provision of the contract, in no event shall OPWC be liable, whether arising under contract, tort (including negligence) or otherwise, for any special, incidental or consequential loss or damage of any nature arising at any time or from any cause whatsoever.

6. Hold Harmless

The Purchaser, his assigns and successors in interest, shall indemnify and hold harmless OPWC from any and all liability claims, suits, expenses, damages or loss in connection with bodily injuries to any person or persons including death at any time resulting therefrom and in connection with any damage to or loss of property including the products furnished hereunder, or other property whether or not owned by the Purchaser, resulting from the operation or use of the products furnished hereunder. The Purchaser shall at his own expense defend any and all suits brought against OPWC alleging any such injury, death, damage or loss, even if such suit or suits are groundless, false or fraudulent.

7. Notification of Claims

The Purchaser shall notify OPWC immediately by certified mail addressed to OPWC at P.O. Box 750384, Dayton, Ohio 45475-0384, of all claims brought against the Purchaser for which OPWC may be liable; and OPWC shall notify the Purchaser immediately by certified mail addressed to the Purchaser at the address of shipment of all claims brought against OPWC for which the Purchaser may be liable.

8. Governing Law

Purchaser and OPWC agree that exclusive jurisdiction and venue for all litigation arising under this contract lies with the courts of Lorain County, State of Ohio, and further to submit jointly and individually to the jurisdiction of such courts.

9. International Orders

International Orders are defined as those orders being shipped to anywhere outside the domestic, continental United States. The only acceptable payment method for International Orders are via wire transfer of funds directly to our bank account.

Please contact us to obtain a total price for your order. The total price includes shipping to an address in the continental United States. If you do not specify a shipping address in the continental United States, then you must make arrangements for an export and shipping company that you deal with directly. We will provide an address for your shipping company to receive the items.

The only export paperwork we provide is a detailed packing list and original invoice. All other export paperwork requirements are your responsibility.

A telephone number MUST be provided on all shipments. Once you have the total price, you may then contact us for wire transfer account information. Once funds have been verified in our account, your order will be processed. (Verification of funds may take 5-10 calendar days).

International Orders are considered Special Orders and may not be returned for any reason or under any circumstance. And, any additional fees, including but not limited to, tariffs, duty, taxes, import charges, etc. are not included in our price and are the sole responsibility of the receiving party. Contact your country's government for any possible and applicable expenses that may be associated with the receipt of our products.

EXCEPTION: Orders being shipped to Alaska and Hawaii may provide credit card for payment but must select either UPS 2nd Day or UPS Overnight for the shipping method.
